What Is Circuit Court Mediation?

Voluntary & Confidential

Mediation is a confidential process. Statements made during mediation cannot be used as evidence in subsequent proceedings. This confidentiality encourages candid dialogue and creative problem-solving.

Neutral Facilitation

The mediator does not decide the case — the mediator facilitates communication between the parties, helps identify interests and priorities, and guides the parties toward a mutually acceptable resolution.

Cost-Effective Resolution

Mediation typically resolves disputes faster and at a fraction of the cost of trial. A successful mediation eliminates the uncertainty of a jury verdict and allows parties to craft their own resolution.

Court-Ordered & Voluntary

Florida courts routinely order mediation before trial in civil cases. Parties may also elect mediation voluntarily at any stage of a dispute — before or after litigation is filed.

How the Mediation Process Works

01

Pre-Mediation Preparation

Each party submits a confidential mediation statement outlining their position, key facts, and settlement objectives. The mediator reviews these materials in advance.

02

Joint Session

The mediation begins with a joint session where each party has an opportunity to present their perspective. The mediator sets ground rules and establishes a constructive tone.

03

Private Caucuses

The mediator meets privately with each party to explore interests, discuss strengths and weaknesses, and facilitate movement toward resolution. These sessions are confidential.

04

Agreement or Impasse

If the parties reach agreement, the terms are reduced to writing and signed at the mediation. If impasse is reached, the parties retain all rights to proceed with litigation.
