Maritime Injuries Require Maritime Expertise.

Injuries occurring on navigable waters are governed by a distinct body of federal maritime law that differs significantly from state tort law. Mr. Medina has handled maritime injury cases on both the plaintiff and defense sides — that dual perspective is a decisive advantage when your case goes to negotiation or trial.

Federal Maritime Injury Claims

Federal maritime law — also known as admiralty law — governs injuries that occur on navigable waters of the United States. This body of law provides several distinct remedies for injured maritime workers and passengers that are not available under state tort law, including the Jones Act, the general maritime law doctrine of unseaworthiness, and maintenance and cure.

The Jones Act (46 U.S.C. §30104) provides seamen — workers who spend a substantial portion of their time in service of a vessel on navigable waters — with the right to sue their employer for negligence. Unlike standard workers' compensation, the Jones Act allows seamen to recover full tort damages, including pain and suffering. The negligence standard under the Jones Act is extremely favorable to injured workers: even the slightest negligence by the employer is sufficient to establish liability.

In addition to Jones Act claims, injured maritime workers may pursue claims for unseaworthiness (the vessel owner's absolute duty to provide a seaworthy vessel and crew) and maintenance and cure (the vessel owner's obligation to pay daily living expenses and medical treatment until the seaman reaches maximum medical improvement). Passengers injured on vessels may pursue general maritime negligence claims. We handle all of these claims throughout Florida and federal courts.

How Mr. Medina Handles Your Maritime Injury Case

Maritime injury cases require immediate action. Evidence aboard vessels can be altered or destroyed quickly. We move fast to preserve the vessel, obtain the vessel's logs and maintenance records, interview witnesses, and retain maritime experts. We identify every applicable theory of recovery — Jones Act negligence, unseaworthiness, maintenance and cure, and general maritime negligence — and pursue each one.

Mr. Medina's experience on the defense side of maritime litigation means he knows exactly how vessel owners and their P&I clubs evaluate and defend these claims. He knows which arguments they will make, what evidence they will seek, and how to position your case for maximum recovery — whether through settlement or trial in federal admiralty court.

We calculate every element of your damages — past and future medical expenses, lost wages and diminished earning capacity, pain and suffering, and the full impact of your injuries on your life and livelihood. Maritime injury cases often involve complex jurisdictional and choice-of-law questions that require experienced admiralty counsel. We handle that complexity so you can focus on your recovery.
